I would like to have seen JKR try to prevent the Oxford English Dictionary from putting “Muggle” in the dictionary, using the argument that she came up with the word. Either giving away the plot is harmful or not, permission or not. That is the legal issue. And since the movies already do that, the harm is done.

This case is “slam-dunk”, imo, but the law will not allow the judge to say so nor is that how it works. In any case, we are all familiar with the long tradition of “perverse” verdicts in the history of the judicial system; human error and misjudgement are an inherent part of all legal processes. [...]

It’s not ethically sound, in my opinion, for the Defense to excuse behaviour in the defendants that the defendants themselves would- and have- objected to when such behaviour is against them.

The Lexi-book is not a companion work, but if you want to make that comparison and call it one, then you’ve just invalidated its legality. Why? Because only an author has the right to create or license to be created, companion works.

Rowling might object that the fan’s guide will be strewn with errors or poorly written; but it is hardly the job of copyright to protect us from bad execution. And the fan’s guide might actually be better, or at least different.
